While I do agree that the work rightfully belongs to the commissioner who paid/bought the thing what he was doing was more dumb then a bimbo doing... well bimbo things.

So I have no clue what is the story going on here about this guy, nor do I care really, but I do feel the need to say something else about commissioning of artwork.
Now IANAL yet, but I have had to deal with a few of these. If you commission an artist to do work for you, even if on your ideas, and you do not have a contract in place to transfer the copyright from the artist, the artist will have copyright on the work even if you pay for it. You will not have the right to copy the work and then resell it. Honestly, it is even questionable for you to use it for anything but for personal own consumption without a release, like using it on your own website. The most common instance of this that most of us will know is having pictures done at a professional photographer. You walk in, you pay them, but they hold the copyright. You cannot legally reproduce the picture even of yourself without a release or transfer of copyright. Paying someone on say Deviant Art to draw a librarian growing huge tits is not different. So if you pay for a commission ask the artist how they feel about what you do with the work after, usually simply asking makes everything that much smoother. I mainly wanted to point this out to keep the artists in the community happy. |
